1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business, organisation or other party requesting and receiving our services.

Services means any rubbish clearance, waste collection, loading, removal, transportation and associated services carried out by the Company.

Waste means any waste materials, items, junk, rubbish, household waste, commercial waste or other materials presented by the Customer for collection, subject to any exclusions in these Terms and Conditions.

Quotation means the estimated or fixed price given to the Customer for the Services, whether provided in writing, by email, by message, by telephone, or in person.

2. Scope of Services

The Company provides rubbish clearance and waste removal services, including but not limited to household rubbish clearance, office and commercial waste collection, garden waste collection, bulky item removal, and general junk removal. Services are provided within our service area and are subject to staff and vehicle availability.

We reserve the right to decline any job where we reasonably believe that carrying out the Services would be unsafe, unlawful, unsuitable for our capabilities, or outside the scope of our waste carrier registration.

3. Booking Process

3.1 Bookings can be made by telephone, email, online form, or other communication methods offered by the Company. The Customer must provide accurate and complete information about the type and approximate volume or weight of waste, the property access, any parking restrictions, and any items that may require special handling.

3.2 All bookings are subject to availability. The Company will confirm the booking date and time window. Any booking confirmation provided by us does not guarantee a specific arrival time, but we will use reasonable efforts to attend within the agreed time window.

3.3 The Customer must ensure that either the Customer or an authorised representative is present at the property at the agreed time to provide access, confirm the work required, and approve any adjustments to the quotation where necessary.

3.4 The Company may request photographs or a detailed list of items prior to confirming a booking. This information helps us to provide a more accurate quotation and to allocate an appropriate vehicle and team.

4. Quotations and Pricing

4.1 Unless otherwise stated, any quotation provided by the Company is an estimate based on the information supplied by the Customer. The final price may vary if the actual volume, weight, type of waste, access conditions or working time differ from the information originally provided.

4.2 Our pricing is generally based on one or more of the following: the volume of waste loaded, the weight of waste removed, the nature of the waste, access conditions, labour time, and any additional services requested by the Customer, such as dismantling or packing.

4.3 On arrival, our team will assess the waste and confirm or revise the quotation before commencing work. If the revised price is not acceptable to the Customer, the Customer may decline to proceed. In such circumstances, a call-out or minimum attendance fee may be charged, provided this has been communicated in advance.

4.4 All prices quoted are exclusive of any applicable VAT, unless clearly stated otherwise. Where VAT applies, it will be charged at the prevailing rate.

5. Payments

5.1 Payment is due on completion of the Services on the same day unless agreed otherwise in writing in advance. The Customer must ensure that funds are available and that an authorised person is present to make payment.

5.2 We accept payment by cash, debit card, credit card, bank transfer, or other payment methods that we may offer from time to time. We reserve the right to request full or partial payment in advance, particularly for large jobs or commercial contracts.

5.3 For account customers or commercial clients with agreed payment terms, invoices are payable within the period specified on the invoice. If no period is specified, payment is due within 14 days of the invoice date.

5.4 The Company reserves the right to charge interest on overdue amounts at the statutory rate permitted under UK law, accruing on a daily basis until payment in full is received. The Customer shall also be responsible for all reasonable costs incurred by the Company in recovering any overdue sums, including legal costs and debt collection agency fees.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by giving the Company as much notice as reasonably possible. Cancellations or major changes made less than 24 hours before the scheduled arrival time may incur a cancellation charge or minimum call-out fee to cover our costs.

6.2 If our team arrives at the property and is unable to gain access, or the Customer fails to attend without prior cancellation, we may charge a wasted journey or attendance fee.

6.3 The Company reserves the right to cancel or reschedule a booking where necessary due to circumstances beyond our reasonable control, including vehicle breakdown, staff illness, adverse weather, traffic conditions, or other operational issues. In such cases, we will make reasonable efforts to notify the Customer and rearrange the Services as soon as practicable. The Company will not be liable for any loss arising from such cancellation or delay.

7. Customer Responsibilities

7.1 The Customer must ensure safe and reasonable access to the waste for our operatives and vehicle. This includes making sure that driveways, corridors, stairways, lifts, and pathways are clear and safe for use.

7.2 The Customer is responsible for obtaining any necessary permissions for access, including permission from landlords, neighbours, building managers, or local authorities for parking or entry through communal areas.

7.3 The Customer must inform the Company in advance of any hazards that may affect our operatives, such as sharp objects, hazardous materials, contaminated areas, or unsafe structures.

7.4 The Customer must not present for removal any waste that is prohibited or restricted by law, by our waste carrier licence, or by these Terms and Conditions, unless expressly agreed in writing.

8. Waste Types and Prohibited Items

8.1 The Company operates as a licensed waste carrier and will handle and dispose of waste in accordance with UK waste regulations and duty of care requirements. Our Services cover general household and commercial waste, subject to exclusions.

8.2 The following items are generally prohibited unless specifically agreed: asbestos, clinical or medical waste, chemical waste, solvents, oils, gas bottles, explosives, corrosive substances, large volumes of liquids, and any other materials classified as hazardous under UK law.

8.3 Where the Customer presents prohibited or undeclared hazardous items for removal, the Company may refuse to collect such items, may adjust the quotation to cover specialist handling and disposal, or may terminate the Services. Any costs incurred by the Company in safely managing such items due to the Customer's failure to disclose them will be charged to the Customer.

8.4 The Customer remains responsible for any prohibited or hazardous items left on the premises and for any consequences arising from their presence, except where the Company has expressly agreed in writing to handle such items.

9. Performance of the Services

9.1 Our operatives will carry out the rubbish clearance and waste removal with reasonable care and skill, taking account of the conditions at the property and the nature of the waste.

9.2 Unless explicitly included in the quotation, our Services do not cover cleaning, extensive dismantling of fixtures, or repairs to surfaces or structures. Light sweeping after waste removal will be undertaken at our discretion and where feasible.

9.3 Time estimates provided for completion of the Services are approximate and not guaranteed. The duration of a job may be affected by access, volume of waste, parking, and site conditions.

10. Liability and Limitations

10.1 The Company will exercise reasonable care to avoid damage to the Customer's property during the provision of the Services. However, the Customer must notify us immediately, and in any event within 48 hours, of any alleged damage caused by our operatives.

10.2 Our liability for any proven loss or damage to the Customer's property arising directly from our negligence shall be limited to the reasonable cost of repair or replacement of the damaged item, subject to evidence of value and condition. We are not liable for pre-existing damage or wear and tear.

10.3 The Company shall not be liable for loss of profits, business interruption, loss of business opportunity, or any indirect, special or consequential losses arising out of or in connection with the Services.

10.4 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot legally be excluded or limited under UK law.

11. Waste Transfer and Environmental Compliance

11.1 The Company operates in accordance with applicable UK environmental and waste management regulations. We will transport and dispose of waste using authorised facilities and methods.

11.2 Where required, a waste transfer note or consignment documentation will be completed. The Customer must provide any information reasonably requested to complete such documentation accurately.

11.3 Once waste has been collected and loaded onto our vehicle, legal responsibility for that waste passes from the Customer to the Company, except in cases where waste is returned to the Customer due to safety, regulatory or other lawful reasons.

11.4 The Company supports the reduction, reuse and recycling of waste. Where appropriate and practicable, items may be reused, donated or recycled instead of being sent for disposal.

12. Delays and Events Beyond Our Control

12.1 The Company shall not be in breach of these Terms and Conditions nor liable for delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control.

12.2 Such events may include but are not limited to extreme weather, traffic incidents, accidents, breakdowns, strikes, public disturbances, acts of government or regulatory bodies, or any other events that could not reasonably have been anticipated or avoided.

13. Insurance

13.1 The Company maintains appropriate public liability insurance and, where required, employer's liability insurance, to cover its operations as a rubbish clearance and waste collection service provider.

13.2 The existence of insurance does not extend our liability beyond the limits and exclusions set out in these Terms and Conditions and under applicable law.

14. Complaints

14.1 If the Customer has any concerns or complaints about the Services, they should contact the Company as soon as possible, providing full details of the issue, job date, address and, where applicable, supporting photographs.

14.2 We will investigate complaints and aim to respond within a reasonable period. Where appropriate, we may offer to return to the property to inspect or rectify an issue, or offer another form of resolution at our discretion.

15. Data Protection and Privacy

15.1 The Company will collect and process personal data about Customers only for the purposes of managing bookings, providing Services, handling payments, and managing any follow-up communication or legal obligations.

15.2 We will take reasonable steps to keep personal data secure and to comply with applicable UK data protection legislation. Personal data will not be sold to third parties.

16. Variation of Terms

16.1 The Company may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customer's booking will apply to that booking, unless a change is required by law or regulatory authority.

16.2 Updated Terms and Conditions may be made available on request or published on our usual communication channels.

17. Severability

17.1 If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful or unenforceable, such provision shall be deemed deleted, but this shall not affect the validity and enforceability of the remaining provisions.

18. Entire Agreement

18.1 These Terms and Conditions, together with any written quotation or written confirmation provided by the Company, constitute the entire agreement between the Customer and the Company regarding the Services and supersede all previous discussions, correspondence, or understandings.

19. Governing Law and Jurisdiction

19.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

19.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our rubbish clearance and waste collection services.

By proceeding with a booking or allowing our team to commence work, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
